Just in: High Court orders Kwara APC from recognizing Ishowo as Secretary

 


A Kwara State High Court, Ilorin, has stopped the state chapter of All Progressives Congress (APC) from recognising Alhaji Mustapha Salman Isowo, as the secretary of the chapter.


The order was sequel to a motion ex-parte filed by counsel to members of the party in Alanamu Central Ward, Ilorin West Local Government Area of the state.


It is recalled that members of the party in ward after they suspended Ishowo on the allegation of anti-party, dragged the state chapter of the APC to court to prevent his further recognition.


According to the originating summons dated February 16, 2023 and deposed to by one of the three claimants in the matter, Jaji Abdulganiy, on behalf of the party, the ward asked the court to restrain the state chapter of the APC (2nd defendant), forthwith from further recognising Isowo as its secretary in the state.


They asked the court to further declare that Isowo acting as the secretary of the 2nd defendant in spite of his suspension is “ultra vires, illegal, null and void”.


In the order granted by Justice I. A. Yusuf on March 2, 2023, the court restrained the state chapter of the APC from recognising Isowo as the state secretary of the party, pending the hearing and determination of the motion on notice already filed.


“ORDER UPON A MOTION EX-PARTE and supporting affidavit dated March 2, 2023 and filed on the same day.


AND AFTER LISTENING to A. O. Abubakar, Esq learned counsel to the Claimants/Applicants, moved the motion ex-parte and the
court having considered the application moved, granted same as prayed
IT IS HEREBY ORDERED that parties are to maintain status quo and ensure peace pending the hearing of the motion on notice already filed.
The case is adjourned to March 13, 2023 for hearing of the motion on notice

GIVING AT ILORIN UNDER the seal of the court and hand of the presiding Judge on March 2, 2023”.


Also, members of the APC in Alanamu ward have demanded for compliance with the court order restraining Alhaji Isowo from parading himself as the state secretary of the party.


Counsel to the Claimants/Applicants, I.0. Jimoh Esq, a principal partner for Olasehinde J. Adeseko & Co, in a statement said that rule of law is supreme, adding that, “being the position of the law, the Order of the Court must be obeyed


We hereby bring to your attention, the Order of the Court made and dated March 2, 2023 restraining the Defendant/ Respondent from parading himself as the Secretary of the 2nd Defendant respondent; Kwara State Chapter of the APC pending the hearing and determination of the Motion on Notice.

“It is equally contained in the Order that the 2nd Defendant is restrained from further recognizing the Defendant/Respondent as its secretary in Kwara pending the hearing and Determination of motion on notice.


“It is pertinent to note that the order was granted as prayed.


“We wish to draw your attention to the fact the rule of law is supreme and being the position of the law, the Order of the Court must
obeyed.
